Work permits\u00a0<\/span><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>According to the provisions of the &#8220;Exit and Entry Administration Law&#8221; implemented foreigners working in China should obtain work permits and work class residence certificates to work legally. Otherwise, it&#8217;s deemed as &#8220;illegal employment&#8221;.<\/p>\n<p style=\"text-align: center;\"><img decoding=\"async\" src=\"https:\/\/media.hiredchina.com\/Fv7DoQn51Xgx4l0xX7TKShr5sfHb?imageView2\/0\/format\/webp\/q\/75\" alt=\"1.gif\" width=\"598\" height=\"333.1714285714286\" title=\"\"><\/p>\n<hr \/>\n<p>Compared with Chinese employees, they just begin working and they\u00a0do not need to process such documents. This rule was made to ensure employers who refuse to sign the labor contract with their employees cannot manipulate the law.<\/p>\n<p><strong>Advice:\u00a0Before signing a contract, you should discuss it with your employer, who should apply\u00a0for a work visa for you. If they don&#8217;t offer a work visa, then you can choose to apply by yourself or reject the work in this company.<\/strong><\/p>\n<h3 style=\"text-align: center;\"><span class=\"ez-toc-section\" id=\"2_Internships_are_restricted\"><\/span><strong><span style=\"color: #e33737;\">2. Internships are restricted<\/span><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Internships for foreigners are theoretically restricted. The main issue regarding internships is that the status, \u201cintern\u201d does not officially exist in the Chinese governmental system. Therefore, if a company is willing to employ foreign interns, the candidates must already be studying at a Chinese university under an X-1 Long-Term Student <a target=\"_blank\" class=\"inside_link\" href=\"https:\/\/www.hiredchina.com\/articles\/tag\/visa\/\" title=\"View all posts in Visa\" >Visa<\/a>. The student must receive permission from his or her university and then apply to the Public Security Bureau Entry-Exit Administration for a notation on their residence certificate.<\/p>\n<p style=\"text-align: center;\"><img decoding=\"async\" src=\"https:\/\/media.hiredchina.com\/FqT0FKaxRnyCyt9ZnxXxWr3p5Tym?imageView2\/0\/format\/webp\/q\/75\" alt=\"2.gif\" width=\"598\" height=\"254.748\" title=\"\"><\/p>\n<hr \/>\n<p>Meanwhile, there are no restrictions on recruiting Chinese interns; it only needs the agreement of the intern.<\/p>\n<h3 style=\"text-align: center;\"><span class=\"ez-toc-section\" id=\"3_Tax_Rules_only_for_foreigner\"><\/span><strong><span style=\"color: #e33737;\">3. Tax Rules only for foreigner<\/span><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>In China, Tax rules for foreigners are different, mainly being based on your duration in China:<\/p>\n<p style=\"text-align: center;\">\u00a0<img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/media.hiredchina.com\/FjxwhOh71rA0FK_zYpVIZz6LmXcB?imageView2\/0\/format\/webp\/q\/75\" alt=\"3.jpg\" width=\"1080\" height=\"1287\" title=\"\"><\/p>\n<hr \/>\n<p>Tax for Chinese citizens is based on monthly income.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<h3 style=\"text-align: center;\"><span class=\"ez-toc-section\" id=\"4_Tier_Classification_System\"><\/span><strong><span style=\"color: #e33737;\">4. Tier Classification System<\/span><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Under this policy, foreign applicants will be divided into three categories based on a scoring system. Credits will be assigned to applicants for Work Permits based on their education, background, salary level, age, time spent working in China, and Chinese language fluency. Many cities now operating under this policy have issued local standards for the scoring system.<\/p>\n<p>Category A\u00a0applies to foreign high-end talent.<\/p>\n<p>Category B applies to foreign professionals.<\/p>\n<p>Category C\u00a0applies to the remaining types of foreign workers.<\/p>\n<p>There are no categories of this type for Chinese workers.<\/p>\n<h3 style=\"text-align: center;\"><span class=\"ez-toc-section\" id=\"5_Retirement_age\"><\/span><strong><span style=\"color: #e33737;\">5. Retirement age<\/span><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Older expats are not like their Chinese counterparts, who are retired completely by the age of 55 or 60, but instead are still active in their <a target=\"_blank\" class=\"inside_link\" href=\"https:\/\/www.hiredchina.com\/articles\/tag\/jobs\/\" title=\"View all posts in jobs\" >jobs<\/a>, or even acting as middle-level and high-level managers or technicians in many companies.\u00a0Although the <a href=\"https:\/\/dictionary.cambridge.org\/dictionary\/english\/employment\" target=\"_blank\" rel=\"noopener\">employment<\/a> certificate is usually restricted by age, the law of China does not prohibit foreigners who exceed the legal retirement age from working in China. As long as the employment certificate is valid, it is legally risky for the employer to terminate the labor contract.<\/p>\n<p>However, when Chinese employees reach the retirement age, the employer may terminate the contract.<\/p>\n<p style=\"text-align: center;\"><img decoding=\"async\" src=\"https:\/\/media.hiredchina.com\/FlBPFE0-bLwhqYMlA17X9BiCzRT8?imageView2\/0\/format\/webp\/q\/75\" alt=\"4.gif\" width=\"598\" height=\"258.336\" title=\"\"><\/p>\n<hr \/>\n<p><strong>Advice: When you reach the China retirement age, you have two choices: one is to apply for retirement based on Chinese rules, another is, if you still want to work for a few more years, then keep just working as you are!<\/strong><\/p>\n<h3 style=\"text-align: center;\"><span class=\"ez-toc-section\" id=\"6_Maternity_insurance\"><\/span><strong><span style=\"color: #e33737;\">6.\u00a0Maternity insurance<\/span><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>As far as specific benefits provided by Maternity Insurance go,\u00a0after conception\u00a0you\u2019ll get benefits\u00a0for natal care, which can include medical consultations, regular checkups, ultrasounds, blood and urine tests, birth defect screenings and more.\u00a0Expats can have children in or outside the country. Female employees may enjoy maternity leave and are not subject to the limit of the number of childbearing. In Beijing and Guangzhou, expats are allowed to receive these benefits for two pregnancies..<\/p>\n<p>According to the Provisions on Female Labor Protection under Special Circumstances (State Council Decree No. 619):<\/p>\n<p>&#8211; 98 days paid maternity leave beginning 15 days prior to childbirth, with extensions of 15 days given under special circumstances (e.g. dystocia).<\/p>\n<p>-15 days extra leave for multiple births, granted per extra child.<\/p>\n<p>&#8211; Approximately 30 days extra leave for women over 24, considered \u201clate maternity leave\u201d or \u201cmaternity rewards leave\u201d (days can vary by location, and foreigners are not eligible for this leave).<\/p>\n<p>&#8211; 15 days maternity leave in cases of abortion of pregnancy of four months or less, and six weeks granted in cases of miscarriage\/abortion after four months.<\/p>\n<p>&#8211; Mothers granted one hour each day to breastfeed during a one year \u201cbreastfeeding period\u201d.<\/p>\n<p>&#8211; Fathers granted approximately 14 days paternal leave (days vary by location, Shanghai offers 10 days while <a target=\"_blank\" class=\"inside_link\" href=\"https:\/\/www.hiredchina.com\/articles\/tag\/shenzhen\/\" title=\"View all posts in Shenzhen\">Shenzhen<\/a> grants 15).<\/p>\n<p>&#8211; Pregnant employees are also protected from termination of employment during pregnancy, maternity leave, and the breastfeeding period. Contracts of employees that are due to expire during these periods must be extended (either by a new contract, or a revised termination date).<\/p>\n<p><strong>Advice:\u00a0Declare\u00a0this responsibility with your employer before you\u00a0signed the contract. See their offer whether <\/strong><strong>fulfill<\/strong><strong> your request. When this problem comes to you, call the\u00a0Bureau of Labour, they will ask you for your employment contract and maternity proof to solve this problem.<\/strong><\/p>\n<h3 style=\"text-align: center;\"><span class=\"ez-toc-section\" id=\"7_Part-time_jobs\"><\/span><strong><span style=\"color: #e33737;\">7. Part-time jobs<\/span><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Many expats have part-time jobs here; as a native English speaker, private tuition is popular in China or with a foreign face some can take part in modeling. But in principle,\u00a0foreign employees (except foreign experts in certain regions) are not allowed to take up part-time jobs.\u00a0Foreign employees can only work in the region and enterprise where the employment certificate is issued from. If the employment area is changed, the corresponding formalities should be handled.<\/p>\n<p style=\"text-align: center;\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/media.hiredchina.com\/FjzoSuMsfiQYMazbv2HPQuyEsVCV?imageView2\/0\/format\/webp\/q\/75\" alt=\"5.gif\" width=\"598\" height=\"299\" title=\"\"><\/p>\n<hr \/>\n<p>Chinese employees can have\u00a0cross regional\u00a0part-time jobs without such restrictions, as long as the relevant parties can reach a consensus.<\/p>\n<h3 style=\"text-align: center;\"><span class=\"ez-toc-section\" id=\"8_Employment_Type\"><\/span><strong><span style=\"color: #e33737;\">8. Employment Type<\/span><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>In many universities, foreign teachers simply sign an employment contract. When the contract comes to its expiry date, employers can decide whether to re-employ you or not.<\/p>\n<p>Differing from Chinese public servant teachers, once you\u2019re employed by this institution, they don\u2019t have\u00a0right\u00a0to fire you.<\/p>\n<h3 style=\"text-align: center;\"><span class=\"ez-toc-section\" id=\"9_Gaokao_exam_for_international_students\"><\/span><strong><span style=\"color: #e33737;\">9. Gaokao exam for <a target=\"_blank\" class=\"inside_link\" href=\"https:\/\/www.hiredchina.com\/articles\/tag\/international-students\/\" title=\"View all posts in international students\">international students<\/a><\/span><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Many top universities, such as Peking and Tsinghua have their own entrance exam for international students.
