The Ministry of Education, together with the Ministry of Science and Technology, the Ministry of Public Security and the Ministry of Foreign Affairs, has formulated the Draft measures for the Employment and Management of foreign teachers to improve the legal system and strengthen the management of foreign teachers, according to the ministry of Education website on July 21.
An important statement made on July 21 stipulates that any foreign teacher employed in China who wishes to seek part-time work opportunities to complement their existig occupation may do so as long as they have made their current employer aware.
This new draft regulation was jointly announced by the Ministry of Education, the Ministry of Science and Technology, the Ministry of Public Security, and the Ministry of Foreign Affairs, all of which agreed that a tripartite agreement between the teacher, their employer, and the third-party offering part-time work, must be signed and submitted to the Exit and Entry Administration Department for legal records.
However, the accumulative teaching hours taken on by the foreign applicant in his/her part-time role cannot exceed the amount of teaching time they are already contracted for with their existing employer.
Getting paid under the table for part-time work makes hiring (and finding work) hassle-free, thereby becoming a popular way of accumulating extra cash in China, and has been so for years. The government aims to encourage part-time teachers to make their side hustles legal.
At the same time, the Education Administrative department of the State Council shall establish a national comprehensive information service platform for foreign teachers, establish a credit record system for foreign teachers, and send the list of prohibited foreign teachers to the Science and Technology administrative department in real time, so as to deal with the illegal acts of foreign teachers timely.
In light of this announcement, the government will introduce a foreign credit system that rewards anyone who they deem as “excellent” foreign teachers.
