China’s recent introduction of a more robust green card and work permit system for foreign workers promises to ease the lives of expats. The goal is to encourage more foreigners to come and work in China.

The new system for foreigners was rolled out nationwide on April 1 this year. Under the new framework, the previous Alien Employment Permit and the Foreign Expert Permit have been combined into a single work permit, issued to any foreigner eligible to take up work in China.

The new ‘three-tier classification’ system and associated polices are intended to bring further benefits to foreign talent working in China. The changes to the system result in a more streamlined process, doing away with inconsistent regional administration, and allows for employers to submit applications online. But it will bring short term challenges to the foreigners and in-house HR practitioners as they adapt their operations and practices accordingly.

How do I read and understand my visa?

  • “Entries” refers to the number of times you are permitted to enter China. It can be single-entry, double-entry, or multiple-entry and good through the validity of your visa.

  • Validity (“Enter Before”) of a visa begins from the date of issue and good through 24h00 Beijing Time of the “Enter Before” date unless the number of entries is used up or the visa is revoked by the Chinese government.

  • Duration of Each Stay is the maximum number of days you are allowed to stay in China on each entry, calculated from the date of entry into China. While in China, you may find your date of departure from China will exceed the “Enter Before” date. You will not be punished as long as your total stay on that entry is within the limit on the “Duration of Each Stay”.

  • Note: Please take notice of the Remarks if any on your visa. All Z, X1, Q1, S1, D visa holders are required to proceed  to and apply for a residence permit from the local Public Security authorities within 30 days upon arrival in China unless the Duration of Each Stay on the visa is marked as 30 days.

I recently received my Work Visa Z Visa / Student X Visa for China. However, I noticed that the “duration of stay” listed on the visa is 000 days. Is this correct, or was this a typo? 

A

That is not a typo. Duration of Stay listed as 000 means to be determined. It is required by law that you register with local public security bureau with 30 days of arrival. Your work visa will be converted to Residence Permit. Duration of stay will be specified by then. Residence Permit normally allows you exit and enter China multiple times within its validity.

Q

What do I do if my foreigner’s work permit is lost or damaged?

A

Applicant shall, from the date of the loss or the date of discovery of the loss, apply for replacement in “Service System for Foreigners Working in China”, provide working in China permit replacement form, fill in it online then print and affix the employer official seal. If lost, applicant should provide loss statement. If destroyed, the original document must be provided.
